Hi,

I'm planning to make a poster to promote a new go club in Grimsby (UK) and I wanted to use a cell from the Hikaru no Go manga.
Would anyone here discourage using copyright material to promote my club?
(I hasten to add that the club is non-profit)
If it gets more people in my area playing the game of go, that's a good thing right?

What do you think? I just don't want to get into trouble!

IF you want to be safe, ask permission of the copy right owner.

by the way, here is what the poster currently looks like:
(also i've pinched a few ideas from other go club posters i've seen online)

Any constructive criticism will be welcomed!

Looks nice, but if you're using copyrighted material - the least you should do is put the copyright line under the picture.

Thanks for the advice. I will probably add a line underneath the picture.

I don't think anyone important will see the posters though, so I won't worry too much.

Yeah, I'd add a credit line to be nice and maybe add something like "all equipment provided" and "free" to help encourage newbies. Also, do you have a location you can add?

Layout looks good!

Thanks all for your input.
Bruce, I have made the changes you suggested.

If the poster attracts only one local player I will be happy! Fingers crossed...

Good luck! The main thing from your end right now is persistence and consistency. Be at the same place, same time each month/week/whatever and with some promotion you should eventually attract some participation and attendance. Whether it is enough (after a time) to continue is your own personal call, but being spotty from the start will definitely sabotage yourself from the get go.

Again, good luck and have fun with this!

Just a quick update:

-"Grimsby Go Club" is now listed on the BGA website (see clubs list)
-I have a weekly advert in the Grimsby Telegraph.
-I have put up posters around Grimsby College and in some of the student halls dotted around town, there is a large population of Chinese students in Grimsby so I am hoping to attract some of them.
(See below for the updated poster, thanks again guys for your advice)

The next step for me if the club takes off:

-Request additional equipment from BGA (stones & boards)
-I would love to have a display board for teaching games/reviews, shouldn't be too expensive?
-I will contact the local Chess club to see if they are willing to share their venue with me. Perhaps then I could even convert a few Chess players to Go! ;)

It really bothers me when I mention the game of Go to someone and they have never even heard of it...
I hope I can help spread the word of Go in my local area, WISH ME LUCK!

Right, so it's fine to steal someone's work if it won't get much circulation...

In other words, it's not stealing that bothers you, but the prospect of getting caught.

1] On the first poster you offered to teach new players.
2] You have only taken a very small portion of the original work
3] If anything your activity may lead to enhanced sales of the original series.
4] You are not profiting.

This is may be considered "fair use".....

Well, fair use is generally when you use something as an example: a quote, an excerpt in a class, etc. Also, fair use applies only when the content used is a very small part of the whole.

Quote:
17 U.S.C. § 107
Notwithstanding the provisions of sections 17 U.S.C. § 106 and 17 U.S.C. § 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:
the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
the nature of the copyrighted work;
the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

kirkmc, you talk as if i'm planning to bankrupt the creators of HNG. in fact, i would recommend the HNG manga & anime to anyone who comes to my club.

also, for the record, the club is non-profit.

Non-profit doesn't give you a license to steal.

I'm simply reacting to the initial comment that shows the person making the poster is clearly aware that he stole the graphics, was not bothered about it because he knew he wouldn't get caught. He seems to have no qualms about using those graphics, which make up the majority of the poster.

i made the poster. and yes, i do have qualms about stealing the image. that's why i made the original post, to gauge everyone's opinion.
it is quite clear that you condemn the poster, but you seem to be in a minority. (not just on this forum)

thanks for your input anyway.

i am quite content with my morals if i know that no damage will be caused by my actions.

@Kirk, seriously? That's your interpretation of his original post?

It sounds to me like the OP wasn't doing it to steal anything, but was wondering if it's acceptable to use material acknowledged as copyright for the sake of promoting a non-profit enterprise. How do you manage to interpret "I just don't want to get into trouble" as "knew he wouldn't get caught"???

I really like the poster. One thing I would say is pick a time and location, and try to make sure it happens. My limited experience is that people are much more likely to "drop in" on a whim for something they know is happening, including when and where, than they are to make a call to someone they don't know to discuss something they may or may not be interested in :)

PS I would also consider it to be fair use

I'm not sure if it falls under fair use according to us law (given http://www.citmedialaw.org/threats/la-t ... e-republic), but since its a british / european anyway, it may fall under "Right to quote" (http://www.internationallawoffice.com/n ... 3d9d71c743).
